Terms of Service

1. Agreement
These Terms, together with our Privacy Policy and any order or plan description you accept at checkout, form a binding agreement between you and MelonNode. If you use the service on behalf of an organisation, you confirm you have authority to bind that organisation.
2. Service description
MelonNode provides Minecraft server hosting and related infrastructure (including control panel access, networking, storage, and optional features such as Velocity network tooling as described on our website). We allocate resources according to the plan you purchase. The service depends on third-party software (including Minecraft server software you choose to run); we do not sell Minecraft licences or Mojang/Microsoft products.
3. Eligibility and accounts
You must provide accurate registration and billing information and keep it up to date. You are responsible for all activity under your account, including actions by anyone you authorise. You must safeguard credentials and notify us promptly of unauthorised use.
4. Acceptable use
You agree not to use the service to:
- Violate any applicable law or regulation.
- Infringe intellectual property, privacy, or other rights of third parties.
- Distribute malware, conduct unauthorised penetration testing against third parties, or participate in denial-of-service attacks (including DDoS) against any network or service.
- Mine cryptocurrency, run cryptocurrency mining software, or use our compute primarily for non-hosting workloads unrelated to your purchased Minecraft hosting without our written permission.
- Send unsolicited bulk email, spam, or phishing, or operate open proxies or anonymisers for abuse.
- Harass, threaten, or harm others, or host content that is illegal in the United Kingdom or your jurisdiction.
- Circumvent technical limits, billing, or security controls, or resell the service in a way that misrepresents MelonNode or overloads shared infrastructure contrary to fair use.
We may investigate suspected violations and cooperate with law enforcement. Breach of this section may result in immediate suspension or termination.
5. Minecraft and third-party software
You must comply with the Minecraft End User Licence Agreement and any applicable Mojang/Microsoft terms. You are responsible for mods, plugins, datapacks, and content you install. MelonNode is not affiliated with Mojang Studios or Microsoft Corporation.
6. Payment and billing
Fees are as shown at checkout or in your customer account unless otherwise agreed. Payments are processed by Stripe (or another processor we designate). You authorise us and Stripe to charge your chosen payment method for recurring subscriptions until you cancel in accordance with our Refund Policy and billing settings.
- Taxes: where applicable, taxes may be added to invoices as required by law.
- Failed payments: we may suspend or terminate service if payment fails and is not remedied within any grace period we communicate.
- Price changes: we may change prices for renewals with reasonable notice where contractually permitted.
7. Service levels and modifications
We aim to deliver reliable hosting but do not guarantee uninterrupted or error-free operation. Maintenance, upstream provider issues, security events, or factors outside our control may affect availability. We may modify features to improve security, performance, or compliance, provided we do not materially reduce the core hosting you have paid for without a remedy where required by law or contract.
8. Intellectual property
We retain all rights in the MelonNode platform, branding, and documentation. You retain rights in your content; you grant us a limited licence to host, process, and display your content solely to provide the service.
9. Suspension and termination
We may suspend or terminate access if you breach these Terms, if we are required to do so by law, or if continued provision would create legal or security risk. You may cancel subscriptions as described in our Refund Policy and panel. On termination, we may delete data after any backup or retention period described in our Privacy Policy, subject to legal holds.
10. Limitation of liability
To the fullest extent permitted by applicable law, MelonNode and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service.
Our aggregate liability for claims arising out of or related to the service in any twelve-month period is limited to the amount you paid to MelonNode for the service in that period (excluding amounts passed through to payment processors). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under English law (including death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
11. Indemnity
You will defend and indemnify MelonNode against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service in breach of these Terms, or your violation of third-party rights.
12. Changes to these terms
We may update these Terms. We will post the revised version and update the "Last updated" date. Where changes are material, we will provide notice by email or in-product message where practicable. Continued use after the effective date constitutes acceptance unless applicable law requires otherwise.
13. Governing law and jurisdiction
These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer in your country of residence.
14. Warranties and disclaimer
Except where expressly stated in writing, the service is provided on an "as is" and "as available" basis. We disclaim all implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, that third-party software (including Minecraft, mods, or plugins) will be error-free, or that defects will be corrected within a specific timeframe.
15. Backups, exports, and data loss
You are responsible for maintaining copies of important worlds, configurations, and files. While we may offer backup or snapshot features, they are not a guarantee against data loss. Events such as user error, software bugs, corruption, ransomware, or catastrophic failure may result in loss of data. You agree that MelonNode is not liable for loss of your content except where such exclusion is prohibited by applicable law.
16. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, failure of public or private telecommunications networks, power failures, or major failures of upstream cloud or transit providers.
17. Beta, preview, and experimental features
We may label certain features as beta, preview, or experimental. Such features may change or be withdrawn without notice, may contain defects, and may not carry the same availability or support commitments as core hosting. Use of beta features is at your own risk.
18. Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, provided your rights are not materially diminished.
19. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, Refund Policy, Minecraft EULA notice, and checkout terms, constitute the entire agreement between you and MelonNode regarding the service and supersede prior oral or written understandings on the same subject, except for fraud or fraudulent misrepresentation.
Consumer complaints
If you are a consumer and dissatisfied with how we have handled a dispute, you may have the right to use an alternative dispute resolution scheme or to contact a consumer protection body in your country. Nothing in this section affects mandatory rights under the law of your residence.
